Article 2 — Scope of application
These General Terms and Conditions of Sale (hereinafter "GTC") apply to all sales concluded on the website www.flashmarques.com between Flashmarques and any non-professional buyer (consumer). Any order implies unreserved acceptance of these GTC.
Flashmarques reserves the right to modify its GTC at any time. The applicable GTC are those in effect on the date of the order.

Article 3 — Products
The products offered for sale are described and presented with the greatest possible accuracy on the site. In the event of an error or omission, Flashmarques' liability cannot be incurred.
Product photographs and visuals are provided for informational purposes only and are not contractual. Slight color variations may exist depending on your screen's display settings.

Article 4 — Prices
Prices are indicated in euros (€), all taxes included (TTC). As Flashmarques is an auto-entrepreneur exempt from VAT (Article 293 B of the CGI), no VAT is applicable or collected on sales.
Shipping costs are specified at the order validation stage and depend on the destination country:
Shipping costs: €2.99 for any order under €29.99;
Free shipping for any order of €29.99 or more (Metropolitan France, Germany, and the United States).
Flashmarques reserves the right to modify its prices at any time. The applicable price is the one displayed at the time of order validation.

Article 5 — Order
To place an order, the customer must:
Select the desired items and add them to the cart;
Validate the cart and enter their shipping information;
Choose their payment method and confirm the order;
Receive a confirmation email summarizing the order.
The order is only definitively validated after payment confirmation. Flashmarques reserves the right to cancel or refuse any order in the event of a previous dispute, insufficient stock, or suspicion of fraud.

Article 6 — Payment
Payment is made online, securely, via the payment methods offered on the site (Visa, Mastercard, American Express credit cards, PayPal, etc.). Payment is processed by Shopify Payments / Stripe. Flashmarques does not store any banking data.
The order is charged at the time of validation. In the event of a payment failure, the order is automatically canceled.

Article 7 — Delivery
Delivery times and conditions are detailed in our Shipping and Delivery Policy, available on the site. In summary:
Order processing: 1 to 3 business days (Monday–Friday);
Delivery time: 7 to 10 business days after shipping;
Delivery zones: Metropolitan France, Germany, and the United States.

Article 8 — Withdrawal and returns
Return and refund conditions are detailed in our Return and Refund Policy, available on the site. In summary:
Withdrawal period: 14 calendar days from receipt;
Items must be returned in their original condition and packaging;
Return shipping costs are the responsibility of the customer (except for errors or defective items);
Refund within 14 business days after receipt and inspection of the return.

Article 9 — Legal warranties
All our products benefit from the legal warranties provided by French law:
Legal warranty of conformity (Articles L.217-4 and following of the Consumer Code): 2 years from delivery;
Legal warranty against hidden defects (Articles 1641 and following of the Civil Code): 2 years from the discovery of the defect.
In the event of a lack of conformity, the customer may request repair, replacement, or, if these solutions are impossible, a refund.

Article 10 — Liability
Flashmarques cannot be held liable for damages resulting from improper use of the products, a force majeure event, an act of the customer, or an unforeseeable and insurmountable act of a third party.

Article 12 — Personal data protection
The data collected during the order is processed in accordance with our Privacy Policy, available on the site, and the GDPR (EU Regulation 2016/679).

Article 14 — Applicable law and jurisdiction
These GTC are subject to French law. In the event of a dispute, and after an attempt at amicable resolution, the French courts shall have exclusive jurisdiction.
